Terms of service

Welcome to Cellar Atlas (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our website, online store, and related services (the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use the Services.


Section 1. Access and account

You represent that you are at least 18 years old and legally permitted to purchase alcoholic beverages in your country of residence.

You may be required to provide accurate, current, and complete information to use the Services, including billing, shipping, and payment details.

You are responsible for safeguarding your account credentials and all activity occurring under your account.


Section 2. Our products

We aim to describe and represent our products accurately. Nevertheless, product appearance (including colors, bottle images, and labels) may vary depending on device settings.

Product descriptions, availability, and pricing may change at any time. We may limit quantities of any item offered.


Section 3. Orders

When placing an order, you make an offer to purchase. Acceptance occurs only after we process payment and send an order confirmation.

We reserve the right to decline, modify, or cancel orders due to:

  • age verification failure
  • suspected resale or misuse
  • address or identity issues
  • stock limits
  • fraud detection

Order cancellation requests may be accepted if the order has not yet been dispatched, but this cannot be guaranteed. Once dispatched, cancellation is no longer possible; the customer must use the legal right of withdrawal.

Purchases must be for personal or household use only.


Section 4. Prices and billing

All prices are listed in EUR and include VAT.

Shipping, handling, and import charges are displayed at checkout.

You agree to provide accurate billing information and authorize us or Shopify to charge your payment method.

We reserve the right to correct pricing errors after checkout.


Section 5. Shipping and delivery

Orders are shipped using our chosen carriers: PostNL, DHL.

Delivery timeframes shown at checkout are estimates and not guaranteed.

Under EU and Dutch law, risk of loss or damage remains with Cellar Atlas until the goods are physically received by the customer.

Failed delivery protections:

  • If the customer is not available during delivery attempts, redelivery or return costs may be charged.
  • If the customer provides an incorrect or incomplete address, costs for redelivery or returns may be charged.
  • If the customer fails age verification upon delivery, the order will be returned and related costs may be charged.

Section 6. Intellectual property

All content on the Services (text, images, tasting notes, product descriptions, logos, layouts) is owned by Cellar Atlas or licensors.

You may not copy, modify, distribute, publish, or scrape content without our written permission.

Anti-scraping rule:

Automated data extraction (including bots, crawlers, scrapers, or price‑monitoring tools) is strictly prohibited.


Section 7. Optional tools

Third‑party tools may be provided “as is” and “as available”. We have no responsibility for their use or functionality.


Section 8. Third-Party Links

We are not responsible for third-party websites linked within the Services. Access is at your own risk.


Section 9. Relationship with Shopify

Cellar Atlas is powered by Shopify, but all purchases are made directly with Cellar Atlas.

Shopify is not responsible for issues arising from your transactions with us.

You release Shopify from claims related to purchases or use of the Services.


Section 10. Privacy

Personal data is processed according to our Privacy Policy and Shopify’s Privacy Policy.

Because Shopify hosts our store, your data may be stored or transferred outside the EU to provide the Services.


Section 11. Feedback and reviews

Any ideas, feedback, or reviews you submit grant Cellar Atlas a perpetual, worldwide, royalty‑free license to use them for business purposes, including marketing.

You warrant you have rights to any content you submit, and it does not violate laws or third‑party rights.


Section 12. Errors and omissions

We may correct errors, inaccuracies, or omissions (including pricing, product descriptions, and availability) at any time and may cancel orders affected by such errors.


Section 13. Prohibited uses

You agree not to use the Services for unlawful activities, harassment, fraud, malware distribution, unauthorized scraping, impersonation, or other harmful behaviors.

We may suspend or terminate your account without notice if Terms are violated.


Section 14. Termination

We may terminate your access at any time. You remain responsible for any charges incurred up to the termination date.

Sections concerning intellectual property, liability, privacy, indemnification, and other relevant areas continue after termination.


Section 15. Disclaimer of warranties

The Services and all products are provided “as is” and “as available”.

We do not guarantee uninterrupted or error‑free operation.

Mandatory Dutch and EU consumer rights always apply.


Section 16. Limitation of liability

To the fullest extent allowed by Dutch law:

  • We are not liable for indirect losses, including lost profits, lost data, or loss of enjoyment.
  • Our total liability for any claim relating to the Services or products is limited to the amount paid for the relevant order.

This limitation does not apply to:

  • liability for defective or unsafe products
  • liability for death or personal injury
  • statutory consumer rights under EU/Dutch law

Section 17. Indemnification

You agree to indemnify Cellar Atlas for losses arising from your breach of these Terms or violation of law.


Section 18. Severability

If any provision is unenforceable, the rest remain in effect.


Section 19. Waiver; Entire agreement

Failure to enforce a provision is not a waiver.

These Terms, along with referenced policies, form the entire agreement between you and Cellar Atlas.


Section 20. Assignment

You may not assign rights or obligations under these Terms without written consent.

We may assign or transfer these Terms at any time.


Section 21. Governing law

These Terms are governed by the laws of the Netherlands.

Disputes will be resolved exclusively before the competent courts of Rotterdam.


Section 22. Changes to Terms

We may update these Terms by posting revised versions. Material changes will be communicated via banner or notice. Continued use constitutes acceptance.
